First Run Update Now Code 304 Failure

This bug persists and a minor annoyance but may bamboozle the mainstream user.

It occurs the first time Update Now is evoked after a product install or upgrade.
Selecting Close for the errored window and then Update Now again will present the correct result.
From then on, the problem does not occur that I have observed to date even after reboots and definition updates.

Version is Free + ClamAV on WinXP Pro SP3.
